Terms of Use

1. Acceptance of Terms

By downloading, installing, or using BidBrush.Pro ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

BidBrush.Pro is a mobile application designed to help painting contractors create professional estimates for their clients. The App allows you to:

• Create and manage painting estimates
• Add client information and project details
• Use preset and custom line items
• Calculate pricing and taxes
• Generate PDF estimates
• Store data locally on your device

3. Beta Testing Program

BidBrush.Pro is currently in beta testing. By participating in the beta program, you acknowledge:

• The App may contain bugs, errors, or incomplete features.
• Features may change or be removed without notice.
• The App is provided free of charge during the beta period.
• Your feedback helps us improve the App.
• Beta access may be terminated at any time.

4. User Responsibilities

You agree to:

• Use the App only for lawful purposes related to your painting business.
• Provide accurate information in your estimates.
• Verify all calculations and pricing before sending estimates to clients.
• Maintain backups of your data using the export feature.
• Not attempt to reverse engineer, decompile, or hack the App.
• Not use the App to create fraudulent or misleading estimates.
• Comply with all applicable laws and regulations in your jurisdiction.

5. Intellectual Property

BidBrush.Pro and all related content, features, and functionality are owned by BidBrush.Pro and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content.
• Remove or alter any copyright, trademark, or proprietary notices.
• Use the BidBrush.Pro name, logo, or branding without permission.

Your Content: You retain all rights to the estimates, client data, and other content you create using the App. We do not claim ownership of your content.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose.
• Warranties that the App will be error-free, uninterrupted, or secure.
• Warranties regarding the accuracy or reliability of calculations.

Important: While we strive for accuracy, you are responsible for verifying all estimates and calculations before presenting them to clients.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIDBRUSH SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages.
• Loss of profits, revenue, data, or business opportunities.
• Errors or inaccuracies in estimates or calculations.
• Data loss due to device failure, app malfunction, or user error.
• Any damages arising from your use or inability to use the App.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (CURRENTLY $0 DURING BETA).

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle your data (spoiler: we don't collect it!).

9. Subscription and Payment (Future)

After the beta period, BidBrush.Pro will transition to a paid subscription model:

• BidBrush.Pro: $10/month for core features.
• BidBrush.Pro.Pro +Plus: $25/month for advanced features (coming in 2026).

Beta testers will receive advance notice and special pricing. Subscription terms will be provided before any charges are made.

10. Termination

You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including:

• Violation of these Terms.
• Fraudulent or illegal use of the App.
• End of the beta testing period.

11. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. You may need to install updates to continue using the App. We may also modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Indemnification

You agree to indemnify and hold harmless BidBrush.Pro and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.
• Estimates or quotes you provide to clients using the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of the applicable jurisdiction.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BidBrush.Pro regarding the use of the App.
